Hi guys,

Posted something similar before but didn't get much help - am hopeless with the legal side of things...have had a quick look online but want to make sure I'm downloading a concise adult release form that covers bases for both the UK & America. The models in question will be shooting porn *gasp* so need to make sure thats covered in it too.


Any links etc you can provide of a release you personally use would be great, thanks!

I tend to use a fairly simple 2257 compliant release which as i am records keeper and based outwith the USA, everybody is happy with, http://image12.photobiz.com/6427/20110428130426_113697.pdf
however this two part style of release is the most common where records are held within the usa and the work is exclussive

I don't see how you can have one that covers all.

The releases I've seen, including mine, end with the words "This agreement is governed by English law and subject to the jurisdiction of the English courts" or words to that effect. That means England and Wales, not UK. There's no such thing as UK law, Scotland is different, never mind the US. If, by America, you want to include Canada, Mexico etc., you will need to put some legalese appropriate to the region to make it even vaguely enforceable.

Jeez, dont complicate things. If an adult release is 2257 compliant and completed in accordance with regulations, its held as adequate by almost every publisher/web company in most countries. Jurisdiction is a different matter which i,m sure the OP has no interest in, but would in most cases lie within the country where the release was signed.
I tend to be a modest man, but then I do have a lot to be modest about.

Ahem, "almost".  ?? There is the rub, everything in law is simple until a lawyer starts to argue about it. Then everything can get complicated.

Whilst I don't doubt that the form of document you linked is used by some producers/record keepers strictly speaking it's not 2257 compliant:

§ 75.2   Maintenance of records.

(e) Records required to be maintained under this part shall be segregated from all other records, shall not contain any other records, and shall not be contained within any other records.

2257 records must be maintained in a separate document from all other records - which includes the model release.

If the material is produced outwith the USA and the records keeper is based outwith the USA, the authorities have no power to examine the 2257 declaration. They would, however, require a webmaster/publisher based within the USA to produce a compliant release and ID

However, some companies elect to buy exclussive rights to the material and elect themselves as record keepers, in such a situation a 2257 declaration needs to be completed.

Hence why I offered two styles of release.

Believe it or not I actually do this for a living....
