Models pay as expense

Hi, are HMRC/my accountant going to get itchy if I position a models pay as a business expense in the context of using the images for a new website venture?

Any experience would be greatly appreciated.

Shouldn't be an issue, although I am no expert.  Best make sure the model declares her income though........

aw yes , as she will be filling out a model release form i would think yeah ??? so if she has filled it in , and hasnt declared her earnings ? she would then get into trouble and possible you too ? if im told correctly ????????

Yes you can claim the full expenses of the model hire. If the model does not declare her income to HMRC it's not your problem.

If you do it 'in the context of' it appears legitimate... Your accountant will probably suck his teeth and ask you to explain - depends on your accountant.


However, if you are selected for investigation, and HMRC do not find any evidence that images from the shoot were ever used for the website then further questions follow... At which point you argue that you didn't like any of the images shot.... And so the argument goes on... Which works for a small number of shoots, but if its multiple shoots, the ground you are on gets increasingly unsteadier.

Given that the sums involved would be fairly trivial in tax terms, and also difficult to prove one way or another I wouldn't lose sleep over it. If there was a substantial fixed asset (in small business terms) such as a vehicle involved, that would be another matter.

As others say, the passage would be very much clearer if the model(s) declared the income as well, and if HMRC really were out for blood, they might check her books too, but for the sort of sums involved I think it unlikely - remember HMRC are only ever going to get 20-odd percent - Unless you are earning an absolute packet of course.

Model fees are a legitimate expense, just ensure she has signed the model release and you have her name address and signature that she received the money from you if its cash, or that your chq stub or BACS transfer has the notes re the payment. A good idea would be to catalogue your images so you can identify the date and model which links up to the payment you made. There is no problem with claiming this, have seen this done many times.

Your accountant is the proper person to ask but if you are running a photographic business I cannot see the issue. Even if it is not for the website it still constitutes legitimate training expenses.If I want to experiment with lighting or perfect a new set up for example I do it using models not customers. Generally I can find plenty who are more than happy to do such sessions for some decent images but where I pay it goes in the accounts.

there is by far too much rubbish spouted about model release forms
and models declaring etc etc etc.

if you are using the photographs for your own web site the
only thing you need is a receipt from the model saying received £n for
modelling services provided.

there is absolutely no need to worry about the model declaring it.
would you worry about your plumber or gardener or thr
driver of the bus you use? of course not !
a proper receipt will include the model's name and address date description
of the services and be signed dated.

your accountant has almost no say inhow you spend your
money if you are a sole trader.

keep it really simple and you should be fine
